The First Tender of the Dedi-Dayat Bungo Regent Era Draws Attention: Alleged Irregularities and Potential Legal Issues

Bungo – The first tender under the leadership of Bungo Regent Dedi-Dayat has drawn intense scrutiny. The six project packages announced by the Bungo Regency LPSE Working Group (Pokja LPSE) on June 5, 2025, at 2:00 PM WIB (Western Indonesian Time) have sparked public controversy. Consisting of five construction projects and one consulting project, the tender process is considered to contain several irregularities, particularly in the evaluation of bidders.

Of the six projects, two are Drinking Water Supply System (SPAM) construction projects in Sungai Puri Village, Tanah Sepenggal Lintas District, with a Cost Estimate (HPS) of Rp1.25 billion, and one in Empelu Village, Tanah Sepenggal District, with a Cost Estimate (HPS) of Rp2.09 billion.

The other three projects involve the construction of Community Health Centers (Pustu) in Bungo Taman Agung Village, Tanjung Gedang Village, and Rantau Makmur Village. These three projects have relatively similar Cost Estimate (HPS) values, ranging from Rp661 million to Rp662 million.

Evaluation Irregularities and Failed Tenders

The Rantau Makmur Community Health Center (Pustu Rantau Makmur) project drew attention because 35 companies participated, but only seven submitted bids. The winner, CV Reformasi Dua, was selected based on the lowest bid of Rp590.65 million, or 10.86% below the HPS (Price Percentage).

However, two other similar projects failed to determine a winner. For the Tanjung Gedang Community Health Center (Pustu Tanjung Gedang), of the 32 companies that registered, only four submitted bids, but all were disqualified by the Working Group for administrative and technical reasons deemed odd by several observers.

CV Wahana Mitra Abadi was disqualified for failing to attend a technical clarification meeting; CV Permata Construction was rejected because its CV documents lacked original signatures; CV Deha was disqualified because the implementing personnel were working as supervisory consultants for government agencies; and CV Karya Pratama Kencana was disqualified due to inconsistencies in the Work Plan and Work Plan (RKK) documents.

Ultimately, the project was declared a failed tender.

CV Abimanyu Jaya Tender: SBU Allegedly Inactive During Bidding

The biggest irregularity was found in the Bungo Taman Agung Community Health Center construction project. Of the 30 companies, seven submitted bids. The LPSE Working Group declared CV Abimanyu Jaya the winner with a bid of Rp616 million.

However, an investigation revealed that CV Abimanyu Jaya's Business Entity Certificate (SBU) for subclassification BG005 (Healthcare Building Construction) had expired on June 13, 2025—the exact date the bidding document submission deadline was set.

This raises major questions about the validity of the documents during the qualification verification stage. If the SBU was indeed inactive at that time, then the Working Group is suspected of having passed a participant who did not meet the administrative requirements.

According to the Procurement Document, Chapter V of the Qualification Data Sheet explicitly states that participants are required to have an active SBU for subclassification BG005. This alleged negligence or violation has the potential to trigger legal and administrative issues in the future.

Working Group Allegedly Washes Its Hands, PPK Could Be Victim

This administratively flawed tender process could have serious implications, especially when the Goods/Services Provider Appointment Letter (SPPBJ) is issued, followed by the signing of the contract (SPK) by the Commitment Making Officer (PPK). If the SBU is proven to be inactive, the PPK will be caught in a legal and moral dilemma.

"The Bungo Regency Government's ULP Working Group must not wash its hands of this issue and sacrifice the PPK," said a public policy observer who declined to be named.

Now, the public and businesses in Bungo are awaiting transparency and a firm stance from the Bungo Regency Government regarding this problematic tender process. If necessary, law enforcement officials and supervisory agencies will intervene to ensure there is no element of tender rigging or practices detrimental to state finances.
