Nigeria’s Supreme Court has definitively ruled that the validity of the 27 Rivers State lawmakers who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) is a “closed chapter,” affirming that only the legislative house—not the courts or governor—holds the constitutional power to declare seats vacant. The judgment, delivered last Friday, emphasizes that defection must be proven through official party registers and membership cards, which the lawmakers failed to provide. The political crisis in Rivers State escalated in late 2023 when 27 PDP lawmakers announced their defection to the APC, citing internal party divisions. Their move sparked legal battles over whether their seats were automatically vacated, as mandated by Nigeria’s Constitution for defecting legislators. The dispute led to parallel sittings by a faction of the House and intensified tensions between Governor Siminalayi Fubara and his predecessor, Nyesom Wike.
